On June 27, 2023, Sean Fraser, Minister of IRCC, announced a new temporary measure that eliminates the restriction on the duration of study programs for temporary foreign workers who do not hold a study permit.

How Long Can I Extend My Study Program for Without a Study Permit?

Effective immediately, foreign workers will have the chance to pursue additional training and education to enhance their careers. This measure will broaden their future work opportunities and increase their chances of transitioning to permanent residency.

Previously, foreign workers were only allowed to study in programs of six months or less while working, requiring a separate study permit for longer programs. This created a barrier for those seeking to enhance their education, receive additional training, or validate their foreign credentials through specific programs.

From June 27, 2023 until June 27, 2026, foreign workers who hold a valid work permit in Canada that was issued on or before June 7, 2023, or a letter issued by IRCC on or before June 7 authorizing them to work while their work permit extension application was in process, can study full-time or part-time in Canada while their work permits are valid, without restrictions on the length of the program.

Fraser said after the Canadian Broadcasting Corporation reported in March that some Indian students had been served with deportation orders for allegedly using false travel documents to enter Canada in an immigration scheme.

According to the CBC, the Canadian government has warned Indian students involved in a fraudulent university immigration scheme that they could face deportation. The students claim they were unaware of the fake credentials and false travel documents and blame the alleged fraud on immigration officials in India who assisted them in the application process. In response, students and advocates have requested a halt to the deportations.

What Will Happen to Students Involved in the Scam?

Fraser indicated that a special task team will investigate each instance of a student facing deportation. The number of those facing deportation was not disclosed to the public. Fraser announced that ongoing deportation would be temporarily halted, permitting students to remain in Canada while their cases are being considered.

According to official figures, Canada welcomed over 800,000 foreign students with active student visas in 2022, with around 320,000 of them being from India. Because of the relatively simple process of obtaining a work visa, Canada is a popular location for overseas students.

Students interviewed by the CBC disclosed that after arriving in Canada, they were informed by agents that they could not attend the institution that had purportedly issued their acceptance letters. They were instead directed to private colleges. When the students finished their education and requested work permits or permission to stay in Canada, the fraudulent scam became apparent.

Fraser pledged that legitimate international students who had been deceived by the scammers will be allowed to stay in Canada. Those who were complicit in the fraudulent plot, on the other hand, would be held liable. Authorities will look into evidence of those who arrived in Canada and immediately began working rather than studying.

  • CELPIP General
  • CAEL
  • PTE Academic
  • TOEFL iBT Test

What Are the Requirements for the New SDS Language Tests

All test results must demonstrate proficiency in the following areas: speaking, listening, reading, and writing.

CELPIP general assessments must yield a score of at least 7 in each of the four language-speaking abilities, which is equivalent to the Canadian Language Benchmark.

CAEL and Pearson PTE Academic test results must have a minimum score of 60.

The TOEFL iBT Test from Educational Testing Service (ETS) requires a minimum score of 83.

These tests must be taken in person by students. Remotely proctored online tests will not be acceptable for SDS applicants.

Prior to this adjustment, the only examinations permitted by IRCC for SDS applicants were IELTS General and IELTS Academic.

The research report, known as Emerging Futures 3 by IDP Connect, indicates that Canada has surpassed Australia and the United States as the preferred choice for international students seeking higher education.

Approximately 27% of the surveyed international students selected Canada as their top choice, while Australia and the United States received 23% and 21% of the votes, respectively. The United Kingdom followed closely behind in fourth place with 18% of respondents favoring it as a study destination.

New Zealand ranked considerably lower, with only 3% of international students selecting it as their preferred destination, while Ireland received a mere 2% of the votes.

It appears that the opportunities available to international students in Canada, such as the ability to work while studying and obtain Post-Graduate Work Permits (PGWP), as well as the possibility of immigrating to Canada through programs like the Express Entry system, heavily influenced their decision to choose Canada as their desired study location.

According to the IDP Connect report, a significant percentage of students worldwide, approximately 63%, consider post-study work opportunities as a primary or influential factor in choosing their study destination. The availability of post-study work programs plays a crucial role in driving demand and attracting interest from various countries.

Immigration Minister Sean Fraser holds an optimistic outlook on the recruitment of international students, viewing them as a potential source of future immigrants to Canada and a skilled workforce that can help address the country’s labor shortages. As a demonstration of this commitment, he recently announced an additional 18-month extension for foreign nationals with expired or expiring Post-Graduate Work Permits (PGWPs).

The situation in Sudan is continuously changing, and movement inside the nation remains difficult and dangerous, limiting IRCC’s capacity to process new applications at this time. To make it easier for those still in Sudan to travel once it is safe to do so, the Canadian government will prioritize the processing of completed temporary and permanent residency applications already in the system from people still in the country. This covers visiting visa applications for qualifying immediate family members of Canadian citizens and permanent residents, allowing them to join their loved ones in Canada.

Sudanese Nationals May Extend Their Stay in Canada

As of April 30, 2023, Sudanese nationals in Canada can request to extend their stay or alter their status as a visitor, student, or temporary worker free of charge. This includes free open work permits, which give individuals access to the labour market and more freedom in supporting themselves while in Canada. These steps will serve to protect the Sudanese people already in Canada by keeping families together and providing them with a safe place to live.

Some permanent residents living outside of Canada may be unable to get access to their Sudanese travel documents. As a result, IRCC is also removing the requirement to have a passport or travel document in order to be granted for a permanent residence visa to enter Canada. These steps are in addition to the fee waivers for passports and travel papers for Canadians and permanent residents of Canada in Sudan, as well as the prioritizing of completed applications for temporary and permanent residence from Sudanese citizens for when it is safe to travel.

Canada Waves Fees for Family Members Fleeing Sudan

On May 4th, 2023, Sean Fraser, Minister of Immigration, Refugees, and Citizenship announced the Canadian government will wave temporary residency application fees for foreign nationals who fled Sudan with Canadian family members.

Foreign nationals who evacuated Sudan with Canadian family members will be eligible to apply for temporary residence without owing the processing fee. They will be able to submit applications for an open work permit or study permit, as well as permanent residence under the family class, after they arrive in Canada.

Sean Fraser, speaking at a news conference in Ottawa on Friday, said that beginning Nov. 15, a prior limit of 20 hours per week that qualified students enrolled in full-time studies were permitted to work off campus will no longer apply.

The unemployment rate in Canada was 5.4% in July, down from a high of 6.0% in April 2022. As of July, Canadian employers were actively seeking to fill nearly 1 million positions.

“There’s more job opportunities than there are workers in almost every community in Canada,” Fraser told reporters, contributing that although some international students will work in service industry jobs, he hopes some will find work in their field of study.

The new policy, which will be in effect from November 15 to the end of 2023, will only apply to full-time students, he said.

Students have voiced concerns that the 20-hour limit exposes them to exploitation because many end up working more hours without protections. Lifting the cap will provide students with more employment options, making them less likely to fall victim to “disreputable employers.”

New Pilot Program for International Students

Furthermore, Immigration, Refugees, and Citizenship Canada is launching a new pilot program to help automate the processing of study permit extension applications.

However, no applications will be automatically rejected under this program, according to Fraser, who added that only immigration officers have the authority to do so.

The announcement comes in the midst of visa delays that have left thousands of international students stranded before the start of the academic year.

Canada Looks to Fix Immigration Application Backlog 2022/2023 https://www.visaplace.com/blog-immigration-law/new-updates-on-canadas-immigration-system/ Fri, 26 Aug 2022 01:39:39 +0000 https://www.visaplace.com/?p=52300 On August 24, Canada’s Minister of Immigration spoke in Vancouver on IRCC’s ongoing efforts to minimize application backlogs, enhance client satisfaction, and solve labor shortages.

As a quick fix, the IRCC has declared that it will have hired up to 1,250 more staff members by late fall in an effort to increase processing capacity, decrease the backlog, and work toward long-term system efficiency. According to IRCC, the new personnel will shorten application processing timelines and enable the processing of new applications at pre-pandemic levels, including the six-month service requirement for Express Entry programs.

Record Numbers Processed in the Last 7 Months

IRCC welcomed 405,00 new permanent residents to Canada in 2021, with a target of 431,000 based on the Immigration Levels Plan for 2022. Record numbers were processed between January and July 2022. Between January 1 and July 31, 2022, 275,000 new permanent residents have come to the country. 349,000 new work permits, including 220,000 open work permits, had been issued throughout the same time period (OWP). Holders of an OWP are able to work in most occupations across Canada.

Applications for study permits increased as well; 360,000 permits have been issued so far in 2022. In comparison to the total number of study permits issued during the same period in 2021, this represents a 31% increase.

IRCC Will Release Monthly Backlog Data

According to the IRCC, processing backlogs have gotten worse as a result of Canada’s humanitarian response to crises and updating dated equipment to keep up with demand. According to their analysis, all business lines combined had about 54% of applications in the system that were older than the service standard as of the end of July. According to IRCC, its current goal is to handle 80% of fresh applications in accordance with service standards.

In response to the backlog, the IRCC said that it will post monthly data on its website and provide further details about additional measures being taken to enhance the system in the coming weeks.

Canada Citizenship Backlog

The Canadian citizenship inventory stands at 444,792 applicants as of July 15, compared to 394,664 on June 1.

Canada Permanent Residence Backlog

The permanent residence inventory stands at 514,116 people as of July 17, compared to 522,047 as of June 6.

Temporary Residence Backlog

The number of individuals applying for temporary residence as of July 17 was 1,720,123, up from 1,471,173 as of June 6.

Express Entry Backlog

As of July 17, a total of 51,616 Express Entry candidates were awaiting results, a considerable decrease from the 88,903 reported on March 15 when comparable data was available.

The IRCC may once more hold all program draws due to the decline in Express Entry backlogs, and the average processing time for new Express Entry applications has returned to six months. The IRCC’s first all-program draw since December 2020 took place on July 6.

Family Sponsorship Backlog

The overall inventory of family class applicants is up to 118,251 persons compared to 112,837 persons on June 6.

Overview of the Backlog in Immigration

The backlog at IRCC has almost tripled since the pandemic. According to the most recent IRCC data, the backlog reached roughly 2.7 million applications by mid-July. However, more recent information made public by the IRCC today shows that as of July 31, the backlog has decreased to about 2.4 million applicants.

The definition of a backlog used by the department has also received an update from IRCC. On its website, it states that applications that are processed in accordance with its service criteria are not regarded as being in the backlog. Applications, however, that are not handled in accordance with its service requirements are added to the backlog.

The department establishes standards for each business line based on the IRCC service standards. For instance, Express Entry has a service requirement that all applications for permanent residency be handled within six months.

The new IRCC webpage states that 47% of the 639,500 applications for permanent residence that are currently being processed meet its service requirements.

In the meantime, 41% of the roughly 1.4 million applications for temporary residence meet its service standards.

In accordance with IRCC service standards, about 65% of the approximately 379,000 citizenship applications are being processed.

The department’s stated goal is to complete 80% of applications within its service standards. The department’s new webpage includes estimates for when it expects to be able to accomplish this goal across all of its lines of business. For Express Entry, the Provincial Nominee Program, and the Spouses, Partners, and Children’s Program, for example, it anticipates achieving this objective by the end of this year.

These costs vary by program, but on average an overseas student may expect to pay about $17,000 in college tuition and about $24,000 in undergraduate tuition per year. Frequently, these expenses do not cover enrollment and admission fees, health insurance, or textbooks. The price of education in Quebec may consequently rise to an unaffordable level.

It is a little-known fact that Quebec provides excellent advantages to foreign students who want to study there. Some have been in place for a long time, while others have only lately been implemented. The list of student groups that qualify for exemptions from Quebec’s increased tuition rates for international students studying abroad is provided below.

Exemptions From Study Fees Outside of Montreal

This is an open work permit that allows graduates to work in Canada for one year before applying for Canada PR. These candidates now have the option to extend their PGWP status or apply for an open work permit!

What is a Post-Graduate Work Permit?

The popular PGWP has been a go-to immigration status for many graduates who came from abroad to study in Canada and now want to stay longer. This work permit is essentially the gateway to permanent residency for international students in Canada and many count on it to make their migration dreams come true! As you may already know, the Post-Graduate Work Permit is a one-and-done status, and extending your status is not possible…until now!

PGWP Holders Can Now Extend Status or Apply for Open Work Permit

This policy change will be affecting those whose PGWP status has or will expire between September 20, 2021, and December 31, 2022. This change was announced to be coming in April 2022 but was delayed due to technical issues. Now we have the instructions on how to apply for an open work permit or extend your status as a PGWP holder!

Here is what you should do according to the following scenarios and your specific situation:

PGWP Expires from October 2, 2022, to December 31, 2022

(Address is up to date and passport is valid until April 2024)

If your address and passport validity is up to date then it’s easy, no need to do anything! If you fall under this category, you should receive an e-mail message from IRCC to confirm your mailing address and an updated work permit will be issued by mid-October!

PGWP Expires from October 2, 2022, to December 31, 2022

(Need to update your address and/or passport validity)

As mentioned above, you will be receiving an email from the IRCC to confirm your mailing address and you will be instructed to update your address if needed! If your passport validity doesn’t allow IRCC to extend your work permit by 18 months, you will not get this e-mail. You will instead receive a separate e-mail in September. This will include instructions on updating your address or passport validity giving you a two-week window to do so. After updating this information, you should receive an updated work permit in the mail by mid-November.

PGWP Expires from October 2, 2022, to December 31, 2022

(Unable to update your address or passport validity)

If you are unable to update your address or passport validity, will need to apply online to extend your work permit. You could receive a work permit extended to your passport expiration date, or you could wait to apply until you have renewed your passport.

PGWP Expires from October 2, 2022, to December 31, 2022

(IRCC didn’t contact you)

If you do not receive a message from IRCC by mid-September, you are not eligible to have your work permit extended through this special process for other reasons. This could be because you now fall under an inadmissibility category. The IRCC still fallows you to apply for an extension, maybe its worth a shot!

PGWP from September 20, 2021, to October 1, 2022

If you are in Canada and your temporary status has expired, you must apply to restore your status at the same time. With these new measures, you are allowed to restore your status, even if it expired more than 90 days ago. You are eligible to apply from abroad if you have left Canada and return after you have been approved!
