This new pilot project, set to launch in September 2023, is known as the Recognized Employer Pilot (REP).

The REP is aimed at simplifying the experience for employers who frequently rely on the TFW Program to staff essential roles in specific fields. Under this program, eligible employers will have the opportunity to secure extended Labor Market Impact Assessments (LMIAs), which will be valid for up to 36 months. This represents a notable enhancement compared to the current maximum validity period of 18 months.

Typically, employers need an LMIA before they can apply for work permits to hire temporary foreign workers. An LMIA confirms the necessity of hiring a foreign worker and certifies the unavailability of Canadian citizens or permanent residents for the position. It also verifies the legitimacy of the job offer and the employer’s compliance with regulations aimed at safeguarding workers.

Requirements and Eligibility for Recognized Employer Pilot

To qualify for the REP program, employers must have received at least three positive LMIAs for the same occupation within the past five years. These occupations must be listed as in demand and supported by data from the Canadian Occupational Projection System (COPS). Additionally, eligible employers must demonstrate adherence to high standards of working and living conditions as well as worker protection. They must also commit to continuing compliance with standard program prerequisites.

In addition to the extended LMIA validity period, participants in the REP program will benefit from a simplified application process for future LMIA applications related to positions on the COPS list.

When Will Canada’s Recognized Employer Pilot Begin?

The pilot will be introduced in two phases:

Phase 1

Starting in September 2023, applications will be open for roles within the Primary Agriculture stream. These Phase 1 occupations, such as livestock laborers, harvesting laborers, greenhouse laborers, and specialized livestock workers and farm machinery operators, have been identified as both in-demand and facing a shortage of domestic labor supply.

Phase 2

The second phase, commencing in January 2024, will allow applications for positions listed in the Phase 2 REP occupations catalog by the Employment and Social Development Canada (ESDC). This expanded list encompasses occupations from diverse sectors like healthcare, food service, construction, trades, and manufacturing. Notably, the Global Talent Stream (GTS) occupations are excluded from the REP program, as they already receive expedited LMIA processing and GTS recruitment benefits based on the current labor market assessment by COPS.

How Long Will Applications Be Accepted?

Applications will be accepted for this trial program until September 2024. But if they need to hire more temporary foreign employees, businesses participating in the REP will still have the choice to fill positions during the pilot period using a streamlined LMIA procedure. In the fall of 2026, the REP program is expected to come to an end.

At its core, this novel program targets roles that are in high demand but lack sufficient domestic labor, showcasing the federal government’s dedication to streamlining labor access for employers and enhancing flexibility in the Canadian labor market.

Tech Strategy for Canada Open Work Permit for H-1B Holders

In the previous month, Sean Fraser, the former Immigration Minister, unveiled a fresh employment authorization designed for individuals holding H-1B visas in the United States. This move forms part of a broader strategy by the federal government to lure overseas talent.

H-1B visas allow foreign individuals to work temporarily within the U.S., particularly in specialized roles, many of which are in the technology sector.

While tech firms significantly increased their hiring activities during the pandemic, they have subsequently initiated substantial layoffs. Consequently, a considerable number of Canada open work permit H-1B visa holders find themselves urgently seeking new job opportunities to avoid having to depart from the U.S.

How Long Was The Tech Program Supposed to Be Open For?

According to the program’s website, this temporary policy will be in effect for a year or until 10,000 applications are received, whichever occurs earlier.

The introduction of this program is a direct reaction to the significant workforce reductions experienced within the technology sector of the United States. Over the past several months, major corporations like Google, Microsoft, and Amazon have let go of hundreds of thousands of employees.

When the program was initially announced, Fraser highlighted that he was closely observing the developments in the U.S. and recognized them as a favorable “opportunity” for Canada.

Immigration, Refugees and Citizenship Canada noted that the substantial interest in the program underlines the appeal of Canada to highly skilled professionals. In an email statement, a representative stated, “When it comes to attracting international talent, we remain a top destination.”

Following changes to the Immigration and Refugee Protection Act made by the Government of Canada, the introduction of category-based selection draws has been planned in June 2022, and began in June 2023. These improvements have enabled the selection of immigrants based on specific characteristics that match with Canada’s economic aims, such as appropriate work experience to solve labor market shortages and French language ability.

Eligibility Requirements for the Agriculture Occupations Category

You must meet the following requirements to be eligible:

  • Meet the requirements for one of the Express Entry programs (Federal Skilled Worker Program, Canadian Experience Class, or Federal Skilled Trades Program).
  • Have at least 6 months of continuous work experience in one of the mentioned occupations in the last three years.
  • Complete all of the additional requirements outlined in the round’s instructions.

Why Was Agriculture and Agri-Food Chosen as a Category for Express Entry Occupations?

IRCC held discussions to determine immigration selection priorities and categories, obtaining opinions and proposals from a diverse variety of stakeholders and the general public. IRCC also met with provincial and territorial officials to learn more about their potential priorities and requirements.

Agriculture professions were identified as one of the five categories with the greatest need by respondents.

Agriculture, Forestry, Fishing, and Hunting had a job vacancy rate of 10,535 (or 3.9%) at the end of 2022. The following provinces had job openings:

From June 27, 2023 until June 27, 2026, foreign workers who hold a valid work permit in Canada that was issued on or before June 7, 2023, or a letter issued by IRCC on or before June 7 authorizing them to work while their work permit extension application was in process, can study full-time or part-time in Canada while their work permits are valid, without restrictions on the length of the program.

  • a return to the 14-day service standard for work permits under the Global Skills Strategy
  • the promotion of Canada as a destination for digital nomads

Start-Up Visa Program Improvements

Improvements to the Start-Up Visa Program will also be made, which include:

  • allocating more spots to this program for 2023, with further increases planned for 2024 and 2025.
  • applicants will be able to apply for a work permit that is up to three years in duration instead of one year.
  • applicants will be able to apply for an open work permit instead of one that limits them to work for their own start-up.
  • making this three-year open work permit available to each member of the entrepreneurial team instead of only those who are essential and urgently needed in Canada.
  • prioritizing applications that are supported by venture capital, angel investor groups and business incubators and have capital committed, along with applications that are supported by business incubators who are members of Canada’s Tech Network.

With Canada’s first-ever immigration Tech Talent Strategy, said Fraser, “we are targeting newcomers that can help enshrine Canada as a world leader in a variety of emerging technologies. The new measures include:

  • Temporary residence visa (TRV) processing times are reduced for spousal applicants.
  • New and specific tools for spousal TRV candidates
  • A new open work permit is now available for spousal and family class candidates
  • Open work permit renewals are available for open work permit holders whose permits expire between August 1st and the end of 2023

Sean Fraser opened the statement by emphasizing that people from visa-required countries who have submitted family class permanent residency (PR) applications are now qualified to do so for Temporary Resident Visas (TRV), which will allow them to travel to Canada and join their sponsor.

He raised concern that despite the fact that the vast majority of these candidates are ultimately granted permanent residency once their application is reviewed, a significant number of them are being rejected on the basis that they are unlikely to return to their native country.

What Does This Mean For Families of TRV Holders?

Fraser continued by highlighting the accomplishment of clearing the backlog of TRV requests for relatives whose applications for permanent residency are currently in process. Over 98% of spouse and children applications for spousal TRV have been approved since Immigration, Refugees and Citizenship Canada (IRCC) introduced a new strategy. Due to this, they are able to spend time with their family while their applications for PR are being processed.

Temporary Resident Visa (TRV) applications will now be processed more quickly—within 30 days—thanks to the adoption of this new approach. This innovation makes it easier for family members to make their way to Canada and be reunited with their loved ones.

In addition, IRCC is launching a new program to issue open work permits to applicants who are spouses and dependent children living in Canada with their sponsor and obtaining temporary residence status. In accordance with this initiative, dependents, spouses, and partners may apply for and receive an open work permit as soon as they submit a complete application for permanent residence under the spouse or common-law partner in Canada class (SPCLC) or other family class programs.

These open work permits were previously only available for the inland spousal program, but are now available to people applying from outside Canada.

Changes and Extensions For Expiring Open Work Permits

Starting June 7th, open work permit holders whose existing permit expires between August 1st and the end of 2023 can renew their permit for an additional 18 months through a free assisted process, affecting around 25,000 individuals who are currently in Canada and working. This includes the spouses and dependents of most temporary workers, as well as the spouses of international students and permanent residence applicants, as well as their spouses/dependents, who are awaiting the finalization of their permanent status.

What Changes Are Being Made to the New Youth Mobility Arrangement?

The new agreement provides significant enhancements over the 1995 Memorandum of Understanding, including:

  • The eligible age range will expand from 18 to 30 to 18 to 35, enabling a larger pool of young people to take part.
  • Along with the current Working Holiday category, two new streams—International Co-op (Internship) and Young Professionals—will be created, offering more opportunities for participation.
  • Participants will typically have two opportunities to participate in the program, with each chance lasting up to 24 months.

Through this program, young people from Canada and South Korea will have better access to the labour market while also strengthening the interpersonal ties between our nations.

The Canadian government also aims to create significant employment and life experiences for international youth in Canada.

The Honourable Patty Hajdu, who serves as the Minister of Indigenous Services and the Minister responsible for the Federal Economic Development Agency for Northern Ontario, together with His Excellency Roy Eriksson, the Ambassador of the Republic of Finland to Canada, have announced the signing of the Canada-Finland Youth Mobility Agreement.

What Will This New Agreement Do?

This agreement, set to take effect in 2024, will enable young individuals between the ages of 18 and 35 from Canada and Finland to work and travel in each other’s countries through the International Experience Canada (IEC) program or its Finnish equivalent. The IEC program consists of three categories: Working Holiday, International Co-op (internship), and Young Professionals. Participants will have the opportunity to engage in the program for up to 12 months per category.

The agreement aims to strengthen the bilateral relations between Canada and Finland, which have a history of strong connections and shared values. In 2022, the two countries celebrated 75 years of formal diplomatic relations. By facilitating the participation of Canadian and Finnish youth, including Francophone and Indigenous youth, in the IEC program, the agreement seeks to foster cultural immersion, expand life skills, enhance future job prospects, and deepen social ties between the two nations.

Canada Extends the Agri-Food Pilot and Lifts Occupational Cap https://www.visaplace.com/blog-immigration-law/canada-extends-the-agri-food-pilot-and-lifts-occupational-cap/ Wed, 10 May 2023 20:21:36 +0000 https://www.visaplace.com/?p=54677 On May 8th, 2023, Immigration Minister Sean Fraser stated that the Agri-Food Pilot Program will now operate until May 14, 2025. The pilot was established to aid with the transition of skilled agricultural and food industry professionals to permanent residence in Canada.

The Minister also declared that the annual occupational caps would be lifted. According to Immigration, Refugees, and Citizenship Canada (IRCC), lifting these restrictions will allow more qualified people to apply. By the end of the year, IRCC will also make more modifications. The department will gradually implement fresh adjustments to the pilot, such as:

  • Expanding open work permit access to family members of pilot program participants, regardless of occupational skill level
  • Allowing unions to attest for a candidate’s work experience in lieu of employer reference letters
  • Applicants residing in Canada will be offered the option of meeting the job offer requirement, which includes the offer’s median income requirement, or meeting the education requirement (which includes an educational credential assessment verification)
  • For vulnerable workers, the pilot will begin accepting work experience gained through an open work permit. According to IRCC, this will allow more workers to qualify.

What Is the Agri-Food Immigration Pilot Program?

The Agri-Food Immigration Pilot Program in Canada was created in 2020 with the goal of assisting in the reduction of labor shortages in the meat processing, mushroom and greenhouse production, and livestock-raising industries.

When it was first launched, IRCC stated that it will admit up to 2,750 principle applicants plus their family members per year for the next three years.

The pilot’s application deadline was expected to end on May 14, 2023.

According to recent job vacancy data from February 2023, there are over 243,000 individuals engaged in the Agriculture, Hunting, Fishing, and Forestry sector in Canada, with over 14,000 open positions. The COVID-19 epidemic wreaked havoc on the industry, causing factory closures, market fluctuations, and supply chain delays.

Canada Provides Support to Sudan Nationals https://www.visaplace.com/blog-immigration-law/canada-provides-support-to-sudan-nationals/ Fri, 05 May 2023 14:35:41 +0000 https://www.visaplace.com/?p=54633 On April 24, 2023, Sean Fraser, Minister of Immigration, Refugees, and Citizenship, revealed that the Government of Canada has implemented additional immigration policies to assist Sudanese temporary residents who are currently in Canada and may be unable to return home due to their country’s fast deteriorating condition.

The situation in Sudan is continuously changing, and movement inside the nation remains difficult and dangerous, limiting IRCC’s capacity to process new applications at this time. To make it easier for those still in Sudan to travel once it is safe to do so, the Canadian government will prioritize the processing of completed temporary and permanent residency applications already in the system from people still in the country. This covers visiting visa applications for qualifying immediate family members of Canadian citizens and permanent residents, allowing them to join their loved ones in Canada.

Sudanese Nationals May Extend Their Stay in Canada

As of April 30, 2023, Sudanese nationals in Canada can request to extend their stay or alter their status as a visitor, student, or temporary worker free of charge. This includes free open work permits, which give individuals access to the labour market and more freedom in supporting themselves while in Canada. These steps will serve to protect the Sudanese people already in Canada by keeping families together and providing them with a safe place to live.

Some permanent residents living outside of Canada may be unable to get access to their Sudanese travel documents. As a result, IRCC is also removing the requirement to have a passport or travel document in order to be granted for a permanent residence visa to enter Canada. These steps are in addition to the fee waivers for passports and travel papers for Canadians and permanent residents of Canada in Sudan, as well as the prioritizing of completed applications for temporary and permanent residence from Sudanese citizens for when it is safe to travel.

Canada Waves Fees for Family Members Fleeing Sudan

On May 4th, 2023, Sean Fraser, Minister of Immigration, Refugees, and Citizenship announced the Canadian government will wave temporary residency application fees for foreign nationals who fled Sudan with Canadian family members.

Foreign nationals who evacuated Sudan with Canadian family members will be eligible to apply for temporary residence without owing the processing fee. They will be able to submit applications for an open work permit or study permit, as well as permanent residence under the family class, after they arrive in Canada.

This leads to an increase in the number of refugees every year. Canada is recognized as the most hospitable country to individuals from different parts of the world. In 2020, Canada accepted and resettled almost half of the total number of refugees worldwide.

What Does the EMPP Do for Refugees?

The EMPP is a program that allows Canadian employers to fill job vacancies while also giving refugees an opportunity to restart their careers in Canada. A new immigration pathway under the EMPP will become available in the upcoming summer. This pathway will enable refugees and other displaced individuals to find jobs in various occupations such as nurse aides, personal support workers, long-term care aides, software engineers, web designers, mechanical and electrical engineers and technicians, teachers, tourism and hospitality workers, and truck and delivery service drivers.

Moreover, the EMPP is introducing a more flexible approach to eligibility criteria by allowing other displaced individuals who do not have a durable solution and require international protection to apply for the program.

Over the next few years, Canada hopes to expand the EMPP and welcome 2,000 qualified refugees and displaced persons to help fill labor shortages.

Graduates with a recently expired or expiring post-graduation work permit (PGWP) will be eligible for an additional or extended work permit to stay in Canada and gain job experience for up to 18 months beginning April 6, said Immigration Minister Sean Fraser on Friday. Approximately 127,000 post-graduation work permits are set to expire in 2023.

What Do These Extensions Mean for PGWP Holders?

The PGWP program provides international graduates with an open work permit that allows them to gain work experience in Canada. PGWP holders who want to stay longer can begin a voluntary process to extend their work permit beginning April 6.

International graduates whose work permits expire in 2023 will be able to apply for an additional 18-month work permit. Those who were eligible for the 2022 PGWP facilitative measure – a policy change that allowed foreign nationals whose work permit expired between September 20, 2021 and December 31, 2022 to apply for an additional 18 months by either extending or applying for a new one – will also be affected.

Extension for Expired PGWP Work Permits

Under the most recent policy change, international graduates with expired work permits will be able to regain their status, even if they are past the 90-day restoration period. Those who apply will be permitted to work while their application is being processed.

The policy revision comes as employers across Canada struggle to attract and retain skilled workers in the face of a persistent labor shortage. Experts attribute the shortage to a combination of disruption caused by the COVID-19 pandemic and an aging workforce.

The Ministry of Immigration, Refugees and Citizenship said in Friday’s announcement that skilled international graduates “play a vital role in addressing Canada’s labour shortage.” But experts have warned more change is needed to ensure new Canadians are well-matched to jobs that maximize their skills, qualifications and experience.

Visitors who obtained a work permit during the previous 12 months may also apply for an interim work permit under this public policy in order to begin working for their new employer more quickly. Due to labor shortages during the economic expansion, the temporary policy, which was due to expire on February 28th, 2023, has been extended for two more years, until February 28, 2025.

Prior to this policy change, visitors who wished to work in Canada had to submit an initial work permit application before traveling there. They had to leave Canada to obtain a work visa if they were citizens of another country but were already visiting Canada. With this policy, they can stay in the country in order to get their work permit.
