This change will take effect for US-bound plane travelers at midnight on Sunday, according to authorities.

As told by a senior administration official, the CDC is eliminating the limitation that the tourism industry had pushed against for months after finding it was no longer required “based on the science and data.” The CDC can evaluate the order at any moment and perhaps restore it, especially if a new variety emerges that causes worry. Since January 20, 2021, the legislation has been in effect.

According to the source, the Biden administration intends to work with airlines to guarantee a seamless transition, although the shift will likely be welcomed by most in the business.

Airlines for America chief Nick Calio, whose group recently met with White House officials, stated that travel industry officials have been extremely critical of the requirement in recent weeks and have actively urged the Biden administration to repeal it, arguing that it is having a chilling effect on an already fragile economy.

Last month, White House officials met with travel industry representatives, who urged the Biden administration to remove the requirement that immunized overseas tourists take a Coronavirus test before traveling to the United States.

At land ports of entry and ferry terminals along the US-Mexico and US-Canada borders, the regulation applies.

The US had previously required people entering the nation by air transport to be completely vaccinated, but this need has now been extended to land borders. The new rules apply to both necessary and non-essential travel, but not to citizens, lawful permanent residents, or nationals of the United States.

Vaccination Requirements for Travel to the US

Prior to entering the United States, all non-immigrant, non-US citizen travelers are required to be completely vaccinated and produce documentation of vaccination status.

“These updated travel requirements reflect the Biden-Harris Administration’s commitment to protecting public health while safely facilitating the cross-border trade and travel that is critical to our economy,” Department of Homeland Security Secretary Alejandro Mayorkas said in a statement.

Unvaccinated Americans, lawful permanent residents, and nationals of the United States will still be permitted to enter the country via air, ferry, or land port.

On Tuesday, April 20th, the United States added a substantial amount of countries to the State Department’s “Do Not Travel” list – Canada, Mexico, France, and Israel making just a small fraction. This is due to the increasingly high levels of COVID-19 amongst these countries.

Before Tuesday, the State Department listed 34 out of about 200 countries as “Do Not Travel.” It now lists a total of 150 countries at Level Four (Do Not Travel). They have declined to say when updates would be completed.

Although these travel recommendations are not all mandatory, the majority of Americans have already been stopped from traveling to some of these countries such as Canada, China, and most countries in Europe due to their own mandatory laws during this time.

All in all, if you are a US citizen it’s up to you to decide whether travel to international destinations is a good idea, as long as you are allowed into that country. If you want expert input on your decision to travel or not, you should take into consideration the information the US State Department and the US Centers for Disease Control and Prevention provide Covid-19 risk assessments by country.

Other Updates on Travel Between US and Canada

The provincial government in British Columbia plans to restrict non-essential travel between three regional zones, according to a CBC story Friday, April 23.

British Columbia is also working with police to implement the measures and allow them to direct occasional roadside checks into and out of the defined areas, which include the Lower Mainland and Fraser Valley, Vancouver Island and the northern and interior regions of the province.

Many Americans will travel to other countries to receive cheaper medical operations such as dental work, IVF, breast implants, etc. Vaccine Tourism is a newer concept that is driving many non-Americans into the US for the COVID-19 vaccine.

Is Vaccine Tourism Legal?

If you have a visa or are allowed to legally visit the US then, yes, it is legal but there is no guarantee that you will get the shot. There is nothing in place by the government that can promise you a COVID-19 vaccine shot. If you are traveling to the US for a shot you will have to know that you may not get it.

Some countries are already actively preventing Vaccine Tourism like the UK. In the UK you are required to get the vaccine through your doctor and you have to confirm all your personal details which includes your address. Canadian authorities want to see more vaccinated residents so many from Canada are driving across the US border to do so.

New York Vaccine Pop-up for Tourists

The eligibility in New York to get a vaccine changed last week and is now open to any tourists there! The simple answer is yes. Any Canadian will be asked at the US border what their intention of their visit is. The US and Canadian travel is still restricted to only “essential” travel. “Travel for the sole purpose of obtaining a vaccination is not permissible under current travel restrictions,” According to the US Border Protection and Customs.

A Canadian can come to the US on an essential travel trip and while visiting get a vaccine but they can not use the vaccine as their sole reason for traveling to the US. “Canadian residents returning to Canada after receiving essential medical services in the United States may be exempt from COVID-19 testing and quarantine requirements if they have a note from a Canadian licensed health care practitioner indicating the service abroad was essential and a note from a U.S. licensed health care practitioner indicating the resident received the service,” a spokesperson for  Canada Border Services Agency (CBSA).

Some of these ‘snowbirds‘ are hoping to get the COVID-19 vaccine while they’re living in the US for the winter. Florida holds the record for most snowbirds in the US. This southern state continues to have rising COVID-19 cases but they are administering the vaccine to those 65 years or older.

Can a Canadian Get the COVID-19 Vaccine in the United States?

Florida is currently administrating the vaccine throughout its first phase. During the first phase, Florida is offering the COVID-19 vaccine to anyone over the age of 65 along with healthcare workers and those in long-term care. “What you’re now seeing is hospitals being more aggressive with offering vaccinations to our senior citizens. That’s our top priority at this point,” Florida Governor Ron DeSantis said at a press conference on Jan. 7.

Regardless of residency status, any senior citizens older than 65 will get the vaccine according to official statements. Some hospitals in Florida are asking for proof of residency though which could include a state ID, lease/rent agreement, house title, etc. Canadian visitors who are not seniors will have to wait until everyone else can get the vaccine.

“It’s great they’re taking care of the snowbirds who contribute so much to the economy over the years,” Liona Boyd, herself a snowbird, told CTV News from Palm Beach, Fla.

It is currently unclear if Canadians can travel to Florida to get the vaccine without having proof of residency so be sure to contact your local hospital. Prime Minister Justin Trudeau said in a press conference “let’s be clear: this is not the time for a vacation abroad.”

All people except for US citizens, permanent residents, those with US immigrant visas, and most Canadian citizens visiting or in transit, are required to fill out the form. A Customs and Border Protection officer will attach the I-94 Form to the nonimmigrants visitor’s passport. The visitor must leave the US on or before the departure date on the Form I-94.

When exiting the US, the visitor should surrender the Form I-94 to the commercial carrier or to the CBP Officer.

Do I Need the Form I-94 When Visiting the US?

If you are visiting the US by land border ports of entry then you will still need to use an I-94 form. If travelers need the information from their Form I-94 admission record to verify immigration status or employment authorization, the record number, and other admission information they are encouraged to get their I-94 Number.

When You Don’t Need the I-94 Form

If you are visiting the US and arriving by air or sea, you will no longer be required to complete the I-94 Form at Customs and Border Protection. The Customs and Border Protection (CBP) now collections travelers’ arrival/departure information from their election travel records.

  4. People who are in the process of getting a green card
  5. Citizenship is not affected at all.
  6. EB5 is not impacted.
  7. None of the temporary visas from overseas are impacted: H1B, F-1 student visas, B1/B2 visitors, etc. — these are all subject to “normal” processing.

What is a United States Visa Refusal Letter?

A visa refusal letter is the denial of a non-immigrant visa application to the United States. A refusal letter and a denial are used interchangeably but differ from a visa rejection. A rejection occurs when there is something missing in an application and if this is the case, the application will be rejected without prejudice. 

Why did I receive a Visa Refusal Letter?

There are several reasons that you might receive a visa refusal letter. The letter should give a reason why. Below, are explanations of common causes for a United States visa refusal letters.

221 g Refusal

This type of refusal is the result of missing documentation or information on the visa application. The refusal letter will be color coded.

  1. Blue Form: additional supporting documents are needed.
  2. White Form: further processing is needed.
  3. Pink Form: additional processing is being undertaken to check the validity of the provided information.
  4. Yellow Form: longer time is needed to determine the status of the applicant.  

214 (b) Refusal

This type of visa refusal letter is the result of not convincing the Consular officer for one the following reasons:

  1. That the applicant plans to return to their home country.
  2. That the applicant has sufficient funds to complete the trip without gaining employment within the US.
  3. That the applicant will be undertaking appropriate travel, as designated by their visa application.

What are my Options if I have received a visa refusal letter?

221 g Refusal

In order to rectify this type of refusal, you must follow the directions on the specific colored form you received back. This might involve providing more documentation or simply waiting for the additional processing to be completed.

214 (b) Refusal

This type of refusal is not permanent and can be overcome if an applicant provide more evidence that demonstrates the individual’s ties to another country outside of the United States. The interview is an important aspect and can help to demonstrate that you plan on leaving the US after your visit. However, there are some cases in which an individual will not qualify until they experience a change of circumstances in their home country.
